Short answer: Match each notice to the contract by plate and timestamp, then either name the renter as the driver where the law allows or recharge the cost under your signed agreement. Send the evidence before you charge, and book pass-through costs separately from your admin-fee revenue.
A toll gantry or a speed camera photographs the plate, and weeks later the notice lands on your desk, addressed to you. This playbook turns those notices into a repeatable process instead of a margin leak and a customer-service fight.
Key Takeaways
- The notice comes to you, late. New York's Thruway mails toll bills to the registered owner 30 to 45 days after the trip, and Avis says its e-Toll charges can take 4 to 8 weeks after a rental to be billed.
- Match on plate and timestamp against actual pickup and return times, including extensions and vehicle swaps.
- Keep three kinds of money apart: the toll or fine itself (pass-through), any fine you had to pay as owner (a receivable), and your admin fee (revenue).
- Disclose and justify every fee. In August 2026 Spain's consumer ministry fined Avis 1 million euros over admin fees of 33.88 to 45 euros for handling traffic fines; the decision can be appealed in court.
- Evidence first, charge second: the notice, time and place, the signed contract and a fee breakdown.
- 2027 brings more cross-border notices in Europe. EU countries must transpose expanded cross-border enforcement rules by July 20, 2027.

Why tolls and fines arrive weeks after the car is back
The notice goes to the registered keeper (you)
Cashless tolls and enforcement cameras read the plate, look up who it is registered to and mail the bill there. New York's Thruway says plainly that a toll bill "is sent to the vehicle's registered owner using DMV records." Florida's red-light camera law requires the notice to go to the registered owner within 30 days of the violation.
Typical lag and notice windows (verify per jurisdiction)
| Program or jurisdiction | Who gets the notice | Timing | Source |
|---|---|---|---|
| New York Thruway Tolls by Mail | Registered owner | Bills mailed 30 to 45 days after the trip | NY State Thruway |
| Florida red-light cameras | Registered owner | Notice within 30 days; owner affidavit within 30 days of the citation | Florida Statutes 316.0083 (2026) |
| UK speeding (GOV.UK guidance) | The car's keeper | Notices within 14 days; driver named within 28 days | GOV.UK |
| France, camera offenses | Company holding the registration | Driver designated within 45 days | ANTAI |
| EU cross-border offenses | Holder, owner or user of a foreign-registered car | Offense notice within 11 months of the offense | European Parliament summary of Directive (EU) 2024/3237 |
That last row is the 2027 change. The revised EU directive adds offenses such as dangerous parking and breaking vehicle-access restrictions to the list countries chase across borders, and member states must transpose it by July 20, 2027. If you rent cars that cross EU borders, expect more notices, arriving later.
Step 1: Match the notice to the contract
Plate + timestamp vs contract window
Use the date, time and time zone printed on the notice, not the date it arrived. Compare them with the actual pickup and return times on the contract, not the booked times. If you swapped the renter into another car mid-rental, check the swap log, because the plate on the notice may belong to the first car.
Buffer hours and extension edge cases
Decide your rule for the gray zone before you need it:
- Extensions: the contract window must include every extension, signed or not.
- Late returns: a toll 40 minutes after the scheduled return is the renter's if the car came back late.
- Your own staff: delivery and collection drives are your cost, not the renter's.
- Close calls: if a notice sits within minutes of pickup or return and you can't prove who was driving, don't bill the renter.
CarCEO's fines and tolls tools run this plate-and-time match against your contract history and can read a fine from a photo or screenshot with AI, so staff confirm a suggested match instead of searching paper files.
Step 2: Decide what you recharge
Toll principal vs admin fee vs fine
- Toll principal: what the toll operator charges. Pass it through at cost.
- Fines and penalties: where the law lets you name the renter as the driver, do that instead of paying. If you had to pay as the owner, recharge the exact amount.
- Admin fee: your charge for the work. It must be in the signed agreement, and it should reflect real cost.
- Late penalties caused by your slow processing are yours to absorb.
Per-notice vs per-day fee models
The big-brand toll programs below charge per day of toll use with a cap per rental, or a flat fee for every rental day; their fine handling is a fee per notice. Per-day caps feel fairer to renters on long trips; per-notice fees track your actual work.
Benchmark table: published big-brand programs (dated, linked)
| Program | Fee model | Published amount (as of October 2026) | Source |
|---|---|---|---|
| Avis e-Toll (US) | Per toll day, capped | 6.95 USD per toll day, max 34.95 USD per rental (up to 30 days), plus tolls | Avis |
| Avis e-Toll Unlimited (US) | Flat fee for every rental day | 10.99 to 25.99 USD per day, max 54.95 to 181.93 USD per week, by location | Avis |
| Enterprise and National TollPass (US) | Per usage day, capped | 4.95 USD per usage day, max 34.65 USD per rental (7 usage days), plus tolls at the highest undiscounted cash rate | Enterprise TollPass overview, FY2026 |
| Enterprise UK and Ireland (fines) | Per fine processed | Up to 45 GBP (UK) or 35 EUR (Ireland), plus the fine | Enterprise rental terms, January 2024 |
| Avis Spain (fines) | Per fine processed | 33.88 to 45 EUR; ruled abusive, 1 million EUR fine (August 2026, appealable in court) | Spanish Ministry of Consumer Affairs |
The Spanish case is the warning. The ministry found the fee abusive because it charged customers for something the company is legally required to do anyway: tell the authorities who was driving. A 2020 Spanish court ruling had already declared the same clause abusive. Before you copy a big brand's fee, check your own consumer law.
Step 3: Put it in the agreement
Clause checklist
- The renter pays tolls, fines, penalties and congestion or low-emission charges incurred during the rental, including by additional drivers.
- You may give the renter's details to the issuing authority to transfer liability. In England, the rules for moving a council penalty charge to the hirer require a statement of liability signed by the hirer.
- The admin fee per notice or per toll day, and the cap per rental.
- Consent to charge the card on file after return, with how amounts are calculated.
- How much notice you give before charging, and how long after return you may bill.
- A privacy line covering the sharing of renter data with authorities.
Our free car rental agreement template has a fines-and-tolls clause, and the US agreement checklist covers the rest.
Card-on-file consent wording
Card networks treat a charge you initiate after the rental as a merchant-initiated transaction. Stripe says your terms should cover the customer's agreement to such payments, their expected timing and how you determine the amount, and that you should keep a record of that agreement. Sample wording to adapt with your lawyer:
"After the rental ends, you authorize us to charge the card on file for tolls, parking or traffic fines, penalties and related charges incurred during your rental, plus our processing fee of [amount] per notice, up to [amount] per rental. We will send you a copy of each notice and an itemized breakdown at least [number] days before charging. Where the law allows, we will instead identify you to the issuing authority, which will then contact you directly."
Notice period and cap
Give renters time to review before you charge, and state how long in the agreement. Cap total admin fees per rental, and set a final billing window that is realistic for your markets. With EU offense notices allowed up to 11 months after an offense, a 30-day window won't cover every European notice.
Step 4: Notify with evidence
Copy of notice, time/location, GPS trace, fee breakdown
Send one message per notice with:
- a copy or photo of the notice and its reference number;
- date, time, location and plate;
- the contract page showing pickup and return times and the renter's signature;
- a GPS trace or telematics snapshot if you have one;
- the breakdown: toll or fine at cost, admin fee, total;
- how to pay or contest directly, if you transferred liability.
Step 5: Collect without a chargeback
Saved card with consent vs invoice vs deposit deduction
The deposit is usually gone: a standard card hold lasts about 7 days and an extended one up to 30, as our guide to deposit hold expiry explains. That leaves two routes:
- Saved card: fast, and defensible if the agreement covered it and the renter got the evidence first.
- Invoice or payment link: slower, but better when there is no consent on file or the amount is disputed.
If the renter disputes the charge, Stripe's advice is to keep the response short and relevant: the signed contract, the specific clause rather than your full terms, and your messages. A dispute fee applies even if you accept the dispute, and card networks count the disputes you receive, not just the ones you lose. For how these lines should appear on paper, see our car rental invoice guide.
Step 6: Book it correctly
Pass-through liability vs admin-fee revenue vs receivable
| Item | What it is | When you bill the renter | When cash moves |
|---|---|---|---|
| Toll principal | Money owed to the toll operator | Receivable from the renter, payable to the operator | Clear the receivable when paid; the payable when you remit |
| Fine you paid as owner | A cost you settled for the renter | Receivable from the renter, not revenue | Clear when the renter pays |
| Admin fee | Your processing service | Revenue; check whether sales tax or VAT applies | Collected with the rest |
In the UK, HMRC lets you treat a recharge as a disbursement outside the scope of VAT only if conditions are met, including itemizing it separately and recovering only the exact amount you paid. In CarCEO, a toll billed after return posts as a receivable split between admin-fee revenue and a pass-through payable for the toll itself. More on the books side in our payment processing and invoicing guide.
Country notes
US toll-by-plate and photo enforcement
Enterprise's toll program notes that most onsite or cash payment options have been eliminated by tolling agencies, so in practice a rental car on a toll road is billed by plate or transponder whether the renter planned for it or not. Camera tickets follow state law. In Florida, the owner can submit an affidavit within 30 days of the citation naming who had the car, including their name, address, date of birth and, if known, driver license number. Rules differ by state, so build a one-page sheet for each state you operate in.
UK penalty charge notices and driver nomination
Council penalty charges are civil: with a signed statement of liability from the hirer, the hire firm can ask for liability to be transferred. Speeding is criminal: the keeper gets a Notice of Intended Prosecution and a Section 172 notice within 14 days and must name the driver within 28.
France: driver designation
When a camera offense involves a company-registered car, the company's legal representative must designate the driver within 45 days, which ANTAI lets you do online. Failing to designate triggers a separate fine of 675 euros (450 reduced, 1,875 increased), on top of the original.
Germany, and Italy's ZTL zones
Germany also works through the keeper: for parking and stopping offenses, if the driver can't be identified, the keeper can be ordered to pay the costs of the proceedings (section 25a of the Road Traffic Act). Italian city centers restrict access with limited traffic zones (ZTL), and the revised EU directive adds breaking vehicle-access restrictions to the offenses countries chase across borders.
Australia/Canada basics
In New South Wales, companies must nominate the driver for camera offenses. Company fines are five times the individual amount until a driver is nominated, failing to nominate brings an extra fine, and repeat cases can reach 22,000 AUD in court. In Ontario, 407 ETR bills "the rental company (as the vehicle owner)," which then identifies who rented the car and passes the charges on under the rental agreement.
What to automate
Matching, notices, reminders
Automate the boring, deadline-driven parts: plate-and-time matching, templated notices with the evidence attached, and reminders before legal deadlines (45 days in France, 28 for UK speeding notices, 30 in Florida). That is the kind of work fleet management software should take off your desk; if you are comparing tools, start with what car rental software costs and our car rental software overview.
GPS toll estimates are advisory only
GPS data can estimate tolls on a route before the bill arrives, which helps you spot unusual trips early. The authority's notice is still the bill. Never charge a renter on an estimate alone.
FAQ
Who pays a toll on a rental car?
Usually the renter, under the rental agreement. The toll authority bills the car's registered owner, the rental company, which then recharges the renter, often with a disclosed fee. Renters can sometimes pay directly: Avis lists paying the toll authority directly as one way to decline its toll service, and the Golden Gate Bridge accepts a one-time payment up to 48 hours after crossing. Ask at the counter how the program works before you drive.
Can I charge an admin fee?
Usually, if it is disclosed in the signed agreement and reflects real work. Consumer law limits it in some places: Spain's consumer ministry fined Avis in 2026 over fees for identifying drivers, which the law already requires; the decision can be appealed in court.
How long after return can I bill?
As long as your agreement and local law allow. Plan for weeks, not days: New York mails toll bills 30 to 45 days after the trip, and EU cross-border offense notices can come up to 11 months after an offense.
What if the renter disputes it?
Send the notice, timestamps, signed contract and breakdown. If they still refuse, transfer liability to them where the law allows, or answer the card dispute with that same short, relevant evidence.
